Welcome to Binemail! These Terms of Service ("Terms") govern your use of the Binemail mobile application ("App", "Service", "we", "us", or "our"). By accessing or using Binemail, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Binemail, you agree to:

• Be bound by these Terms of Service
• Comply with our Privacy Policy
• Accept any updates to these Terms (we'll notify you of major changes)

2. Eligibility

To use Binemail, you must:

• Be at least 13 years old
• Have a valid Gmail account
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws

If you are under 18, you must have your parent or guardian's permission to use Binemail.

3. Description of Service

Binemail is an email management application that:

• Connects to your Gmail account via OAuth 2.0
• Organizes and categorizes your emails automatically
• Provides smart folders for subscriptions, promotions, and social emails
• Offers storage analytics and email insights
• Enables bulk email operations (Premium feature)
• Provides auto-clean rules and automation (Premium feature)

4. Account Registration and Security

4.1 Gmail Authentication

• You must connect a valid Gmail account to use Binemail
• Authentication is handled securely through Google OAuth 2.0
• We never see or store your Gmail password

4.2 Account Security

• You are responsible for maintaining the security of your Gmail account
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account

4.3 Account Termination

You may delete your account at any time through Settings → Account → Delete Account. Upon deletion:

• All your data will be permanently deleted within 30 days
• OAuth tokens will be immediately revoked
• Premium subscriptions will be canceled (per App Store policies)

5. Permitted Use

You agree to use Binemail only for lawful purposes. You may NOT:

• ❌ Violate any laws or regulations
• ❌ Infringe on intellectual property rights
• ❌ Reverse engineer, decompile, or disassemble the App
• ❌ Attempt to gain unauthorized access to our systems
• ❌ Use the App to transmit malware or harmful code
• ❌ Abuse, harass, or harm others
• ❌ Use automated scripts or bots to access the Service
• ❌ Resell or redistribute the Service
• ❌ Remove or modify any proprietary notices

6. Premium Subscription

6.1 Premium Features

Binemail offers a Premium subscription with additional features:

• Advanced Email Analytics
• Detailed Storage Tracking
• Bulk Email Operations
• Advanced Auto-Clean Rules
• Priority Sync
• Priority Support

6.2 Billing and Payment

• Subscriptions are processed through Apple App Store
• Billing is managed by Apple according to their terms
• Prices are shown in your local currency at the time of purchase
• Subscriptions auto-renew unless canceled at least 24 hours before renewal

6.3 Cancellation and Refunds

• You can cancel your subscription anytime through iOS Settings → Subscriptions
• No refunds for partial subscription periods
• Refunds are handled by Apple per their refund policy
• Cancellations take effect at the end of the current billing period

6.4 Price Changes

We reserve the right to change subscription prices. You will be notified at least 30 days before any price increase. Continuing to use the Service after a price change constitutes acceptance.

7. Intellectual Property

7.1 Our Rights

Binemail and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

• You retain all rights to your email content
• You grant us a license to access and process your emails solely to provide the Service
• We do not claim ownership of your data
• You can revoke this license by deleting your account

8. Data Usage and Privacy

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms. Key points:

• We collect only data necessary to provide the Service
• Email data is cached for 45 days, then automatically deleted
• All data is encrypted end-to-end
• We never sell your data to third parties
• You can request data deletion at any time

9. Third-Party Services

9.1 Google Gmail API

Binemail uses the Gmail API to access your emails. By using Binemail, you also agree to:

• Google's Terms of Service
• Google's Privacy Policy
• Google API User Data Policy

9.2 Apple App Store

Your use of the App Store is subject to Apple's Terms and Conditions.

10. Disclaimers and Warranties

We disclaim all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding data accuracy or completeness

We do not guarantee that:

• The Service will meet your specific requirements
• The Service will be available at all times
• All bugs or errors will be corrected
• The Service will be compatible with all devices

11. Limitation of Liability

We shall not be liable for any:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from unauthorized access to your account
• Damages resulting from reliance on the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Binemail and its affiliates from any claims, liabilities, damages, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your email content

13. Service Modifications and Termination

13.1 Service Changes

We reserve the right to:

• Modify or discontinue any feature at any time
• Change subscription pricing with 30 days notice
• Update these Terms (with notification)
• Temporarily suspend the Service for maintenance

13.2 Account Termination

We may suspend or terminate your access to the Service if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users
• Fail to pay subscription fees

14. Dispute Resolution

14.1 Informal Resolution

Before filing any legal action, you agree to first contact us at support@binemail.app to attempt to resolve the dispute informally.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration, except for:

• Claims relating to intellectual property
• Small claims court actions

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

16. Geographic Restrictions

The Service is intended for use globally, but we make no representation that it is available or appropriate in all jurisdictions. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be replaced with an enforceable provision that most closely reflects our intent.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Binemail regarding the Service and supersede all prior agreements.

19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an in-app notification

Your continued use of the Service after changes constitutes acceptance of the updated Terms.
